William Payne died on October 10, 1660. On his deathbed, Payne left a will stipulating that the 35 acres of land he’d left behind was to be used to channel funds to Ipswich schools. The land cannot be sold in accordance with the will. However, due to gross mismanagement and a lack of revenue being generated show that the wishes of Mr. Payne are not being met. The courts are now faced with a difficult decision; should the land be sold to generate revenue, with the funds to be donated to Ipswich schools, or should the land not be sold at all? The state wishes to sell the land with public schools not objecting to receiving the funds despite many calling for Mr. Payne’s wishes to be upheld.
